Mourning Jesus De Miguel and legal storm around Andorra goalkeeper

The football world is in mourning after the death of Jesus de Miguel, the young striker of CD Tenerife. The forward of CD Tenerife was tackled by Jesus Owono of FC Andorra during the match. Does the goalkeeper risk prosecution?

On Monday evening fate struck in the match between Tenerife FC and Andorra FC in the Spanish second division. Jesus Owono body‑checked Jesus de Miguel to the ground. Tenerife's striker was rushed to the hospital.

Ultimately De Miguel died of a cardiac arrest. Andorra's goalkeeper does not wash his hands of his reckless intervention in innocence.

Legal consequences for the goalkeeper

"I cannot comment on the legal consequences in Spain," says Mathieu Baert. "But in Belgium this could end up in court. Sport is not above the law and the law does not end at the gate of a football stadium," he adds. "This was most likely not a deliberate action by the goalkeeper," Baert states.

"Such a procedure can be civil or criminal," says the sports lawyer. "In the latter case it must be examined whether there is an unintentional killing," he explains. "In such a case the goalkeeper risks a prison sentence," Baert concludes.
